Circle K Settlement: How to Claim Payout Before Deadline
Americans who received a notice that their personal data was exposed in a 2024 cyberattack targeting Circle K may be eligible for cash payments and free credit monitoring under a newly announced class action settlement.
The agreement allows qualifying individuals to either claim a flat cash amount or seek reimbursement for financial losses but only if they submit a valid claim before the deadline later this year.

However, in the case of Circle K, customers can recover financial losses or receive some compensation.
What Is the Circle K Data Breach Settlement?
The settlement resolves a class action lawsuit alleging that Gas Express LLC, which operates Circle K locations, failed to adequately safeguard sensitive personal information that was accessed during a cyberattack on its systems in May 2024.
Under the terms of the agreement, eligible claimants can receive:
- Up to $2,000 for documented out-of-pocket losses tied to the data breach
- A flat $50 cash payment for those without documented losses
- Two years of free credit monitoring and identity theft protection
Circle K has denied wrongdoing but agreed to settle the case to avoid continued litigation.
"Data breach settlements have become commonplace as companies face greater liability for failing to protect personal information," Kevin Thompson, the CEO of 9i Capital Group and the host of the 9innings podcast, told Newsweek.
"The reality is that many companies simply pay the settlement and move on with business as usual. Consumers should understand that these payments are not necessarily an admission of guilt, and a small payout does little to address the long-term risks of having personal information exposed."
Who Is Eligible for the Settlement?
The settlement applies to customers in the United States who were notified that their personal information was impacted by the data breach.
Generally, people may qualify if they:
- Received a data breach notice from Gas Express LLC or Circle K
- Had personal information potentially exposed during the incident
Eligibility does not require proof of financial harm to claim the smaller flat payment, though documentation is required for reimbursement of larger losses.
What Was the May 2024 Circle K Cyberattack?
The targeted cyberattack on Circle K's computer systems exposed files containing sensitive personal information for customers.
According to court filings and settlement notices, the compromised data may have included names, Social Security numbers and other identifying details that could lead to identity theft.
The cyberattack prompted legal action claiming the company did not take sufficient steps to protect the data or prevent unauthorized access.
"In many cases, the settlement amount is pennies on the dollar compared to the potential damage," Thompson said.
What Is the Deadline to Apply?
Class members must submit a valid claim form by September 3 to receive any settlement benefits.
Claims can be filed online or by mail through the official settlement website, using a claim ID and PIN included in the notification letter.
The same date also applies to requests to opt out of or object to the settlement.
What Happens Next
The settlement has received preliminary approval, and a final approval hearing is scheduled for September 18.
If approved, payments will be distributed to eligible claimants after the court finalizes the agreement and any appeals are resolved.
