When is it legal to run a red light? What Georgia law says about traffic signals

In 2019, 143,000 people were seriously injured in crashes because a driver ran a red light. And in that same year, more than 840 people were killed because of red-light runners.

With those numbers in mind, the U.S. Department of Transportation (DOT) is asking the public to do their part in stopping red light tragedies.

“You or your loved ones are more likely to be injured due to a red-light running related crash than any other type of crash,” said the DOT.

The DOT also found that someone runs a red light every 20 minutes on average in urban intersections.

So although it is highly dangerous and illegal, are there ever any circumstances where it is legal to run a red light?

Is it ever legal to run a red light in Georgia?

In general, it is illegal to run a red light in the state of Georgia. But, there are a few exceptions to the rule:

According to Georgia law, you may disregard the traffic lights when a police officer is present and directing traffic in the intersection. Even if what the officer is instructing is opposite of or not matching the traffic light, you must obey the officer’s command.

The second exception to the rule is if the traffic light is malfunctioning.

“If a traffic signal is not functioning at all at an intersection, all drivers must treat the intersection as if a stop sign is posted for all directions,” as stated on the Georgia Department of Driver Services website.

If the traffic light is not working properly and flashing, here is what to do:

Always obey the color of the light that is facing you:

  • If the color of the light is yellow, proceed with caution.

  • If you are facing a red light, you must come to a complete stop and wait until it is safe to go.

What are the penalties for illegally running a red light in Georgia?

In Georgia, failure to come to a complete stop at a red light could result in a traffic violation. This goes for when the driver is turning right on red as well.

In all, there are several penalties for running a red light, some start small, but some penalties can be serious depending on the severity of the situation.

Some penalties include points on your license, fines up to $1,000 and higher insurance premiums.

However, if you cause a collision that results in property damage, serious injury or death when running a red light, the penalties could include costly fines and prison time.
