Is it OK for GA drivers to run red lights if they won’t turn green? Here’s what the law says

There’s no loophole for red lights.
There’s no loophole for red lights.

If you’re one of those impatient drivers who wants to run that red light when it doesn’t turn green, think again. Georgia law says you just have to wait it out, no matter if it’s broken.

In Georgia, there is no law allowing drivers to run a stoplight that will not turn green, a “dead red,” even if the traffic signal appears to be malfunctioning or unresponsive.

Standard law in GA applies to “dead reds”

Under Georgia law (O.C.G.A. § 40-6-20 and 40-6-21) drivers must stop at red lights and cannot proceed until the signal turns green or a police officer directs otherwise.

Exceptions:

The only clear exceptions are:

  • Turning right on red after a full stop (when permitted), or
  • Left from a one-way street onto another one-way street

What to do when stuck at a red light

If a signal is completely out (no lights showing), treat the intersection as a four-way stop. In Georgia there is not a legal way to run a red light. Doing so could result in a citation, fines, or even misdemeanor charges.

The best, and most law abiding solutions:

  • Wait for law enforcement to arrive
  • Attempt to reposition your vehicle to trigger the sensor
  • Turn right (if permitted and safe).

Georgia tried to make “dead red” running legal

In 2015, Georgia lawmakers proposed the Motorcycle Mobility Act that would have made allowances for bicycles and motorcycles in these circumstances. However, then-governor Nathan Deal vetoed it, citing confusion and safety concerns.

Although this seems like a highly inconvenient position to be in as a driver, Georgia just won’t allow it. Waiting is mandated by law, and running the light means you could receive a citation.
