Dallemand drops lawsuit against Bibb schools auditor
Former Bibb County school Superintendent Romain Dallemand has dismissed his federal lawsuit against the Mauldin & Jenkins accounting firm that has provided audits for the school system.
Dallemand's suit, filed Sept. 21, alleged the accounting firm had engaged in misrepresentation, fraud, professional negligence, libel and slander while also interfering with his business relationships.
The dismissal follows a motion filed in October by Mauldin & Jenkins that alleges he fails to state a legal claim for which Georgia law grants relief.
The motion also argues Dallemand's claims for defamation are barred by the statute of limitations which ended about seven months before his suit was filed.
William Newcomb, one of the accounting firm's lawyers, said his clients are "pleased with the dismissal."
Mauldin & Jenkins has denied wrongdoing in the case.
Attempts to reach Dallemand, who is representing himself without a lawyer, were unsuccessful Monday.
Dallemand's lawsuit alleged that Mauldin & Jenkins manipulated and falsified records that ultimately resulted in the loss of his educator license.
An audit of the school system after Dallemand's resignation alleged he'd violated school board policy during his administration by ordering more than $26 million in technology equipment and services without the board's required prior approval.
Results of the audit later were forwarded to the state's Professional Standards Commission, Georgia's educator regulatory agency, and led to the revocation of Dallemand's license.
Dallemand has contended he didn't violate board policy.
