Charges dropped against third Macon brother charged in 2012 killing
Prosecutors have dismissed a murder charge against a third Macon brother charged in the fatal 2012 shooting of a 59-year-old Lizella man.
Citing a “lack of prosecutorial merit,” charges were dropped against 38-year-old Nicholas Taylor last month in the death of Walter Henley, according to Bibb County Superior Court records. Authorities alleged that Henley was shot at his Fulton Mill Road home on Aug. 18, 2012, over a dispute involving payment for a car sold for scrap.
A jury acquitted Taylor’s brother, 32-year-old Nathan Taylor, in March after a four-day trial. Charges were dismissed in 2013 against another brother.
Henley's 15-year-old daughter testified during the trial, saying that a man came to the door of her family's home and a little while later she heard gunshots.
The defense presented alibi witnesses who said Taylor was with them at the time of the killing, although they admitted they didn’t tell police that until about a week before the trial.
Although he was acquitted in the murder case, Nathan Taylor still faces charges stemming from allegations that he illegally had a cellphone while being held at the Bibb County jail awaiting trial.
