Lawsuits in Perry mammogram flap still pending after 3 years

More than three years after they were first filed, 17 lawsuits still are pending stemming from a former Perry hospital radiology technician falsely filing mammogram results that hadn't been read by a radiologist.

Authorities have said 10 of the 1,289 negative results filed in 2009 and 2010 were actually positive.

Rachael Michelle Rapraeger of Macon pleaded guilty in 2014 to computer forgery and 10 counts of misdemeanor reckless conduct.

She was fined $12,500 and sentenced to a stint in a probation detention center followed by about nine and a half years on probation.

Rapraeger, Houston Healthcare doing business as Perry Hospital, Universal Radiology and Staff Care are listed as defendants in the civil cases still pending. A judge awarded $100,000 to plaintiffs in two cases against Rapraeger in 2014.

Attorneys representing Houston Healthcare and Staff Care declined comment. Attempts to reach Rapraeger and an attorney representing Universal Radiology were unsuccessful.

Neal Graham, the Macon lawyer representing plaintiffs in the cases, said motions are pending that await a ruling by the judge before the cases can move forward.

Court records show Houston Healthcare and Universal Radiology have filed motions to dismiss the case or for the judge to rule in their favor without a trial.

The plaintiffs also have filed motions asking the judge to grant summary judgement, deciding certain issues in their favor without a trial, according to court records.
