Falling tile outside a Macon business leaves man with serious brain injury. He’s suing.
A man is suing a Macon property owner after he suffered a brain injury when a tile fell on his head outside a downtown business.
Gregory Scott, a former employee of VIBEZ, is suing 401 Cherry St., owned by James Daws, after a decorative concrete tile fell onto his head in November 2022. As a result, the lawsuit says he suffered “a traumatic brain injury with loss of consciousness, skull lacerations, neck injuries with radiculopathy, bodily contusions and resulting physical and mental disabilities.”
Another tile had fallen before in the same area Scott was injured, according to the lawsuit. It indicates that the broken remnants of the tile stayed on the ground for weeks before being cleaned.
Daws is being sued for premise liability and negligence, claiming he didn’t properly inspect or maintain the area where the tile fell, didn’t remove it and failed to keep the area safe for invitees. He should’ve known that the tiles were negligently installed and were dangerous, the lawsuit asserts, and that he should have changed the tiles or warned invitees to avoid the area.
The lawsuit also argues that Daws failed to make sure appropriate inspections on potential hazardous conditions were performed on the premises. Further, he’s accused of failing to train the employees who installed, inspected and maintained the area regarding safety procedures.
Neither Daws nor representatives of 401 Cherry Street have responded to requests for comment.
A lawsuit represents one side of a legal argument. Daws has not filed a reply as of press time and no actions have been taken in court regarding these accusations.
