Appeals court reverses conviction of former Unadilla police chief

The Georgia Court of Appeals has reversed the 2007 Dooly County conviction of former Unadilla Police Chief Leonard Smith.

Smith’s attorney, Steve Hollomon, said Smith was not afforded an opportunity to know when the case accusing him of “false swearing” would be presented to the grand jury.

He said police officers accused of a crime have the right to make a statement to grand jurors when their case is presented.

Smith was sentenced Aug. 3, 2007, to serve five years in prison for claiming simultaneous work hours at the Unadilla and Fort Valley police departments.

The case has been remanded to the trial court, according to court documents.
