PERRY — A Warner Robins man will serve six more months in jail for an accident in which he was driving drunk and a 5-year-old boy was seriously injured, a Houston County prosecutor says.
Jose E. Burgos-Guevara, 30, was sentenced Monday by Superior Court Judge George F. Nunn to 360 to 390 days in jail after pleading guilty to serious injury by vehicle and drunken driving, said Houston County Chief Assistant District Attorney Jason Ashford.
With credit for time served, Burgos-Guevara has about six more months in jail, Ashford said.
According to Ashford, Burgos-Guevara was traveling south on U.S. 41 Sunday, April 5 at 5:48 p.m. when his pickup truck crossed the center line into the path of an oncoming mini-van. The mini-van’s driver attempted to avoid the pickup truck, which crashed into the passenger side of the mini-van where two children were riding. The 5-year-old, who was buckled in properly in his child safety seat, suffered serious injuries to his face, Ashford said.
Burgos-Guevara’s blood alcohol content was .27 the first test and .283 on the second test, Ashford said. The legal limit in Georgia is .08.
While respectful of the judge’s decision, Ashford said he would have preferred that Burgos-Guevara had received a longer sentence. The judge also ordered Burgos-Guevara to pay $5,000 in restitution for the child’s medical expenses, Ashford said.
