Judge formally dismisses Forest Hill Road lawsuit

A judge has formally dismissed a lawsuit that sought to prevent a state widening of Forest Hill Road.

Bibb County Superior Court Judge Edgar Ennis Jr. signed an order filed Friday consistent with what he announced in court last week, when the plaintiff, activist and dentist Lindsay “Doc” Holliday, could not say how he would continue his case against the Georgia Department of Transportation.

Ennis’ order said an injunction preventing construction work will expire Nov. 27, unless Holliday provides notice that he won’t appeal the case.

The delay is intended to give Holliday a chance to appeal the case and seek another injunction from an appellate court.
