The man who survived being shot eight times at Macons Zodiac Lounge on July 5 also was thrown down a stairwell, according to Macon police.
Sgt. Cedric Penson testified at a Monday court hearing that 37-year-old Percy Welch was actively aggressive toward 21-year-old Deion Davis in a fight before another man shot Davis.
Penson said Welch swung at Davis and threw him down a stairwell, causing Davis head to strike concrete at the club, located at the Riverview Event Center in downtown Macon.
The testimony was given during a commitment hearing in Bibb County Magistrate Court. Welch is charged with attempted murder and criminal participation in street gang activity in connection with the early morning incident that left Davis critically injured and 17-year-old Jamonni Bland fatally shot.
Penson said police intelligence information has shown Welch is a member of Macons Westside Mafia gang. Arrest warrants have alleged seven other people jailed in the case also are members of the gang.
Video surveillance footage and a witness place Welch at the club during the fight that occurred before 30-year-old Andre Maurice Bonner allegedly shot Bland and 27-year-old John Michael Hollingshed allegedly shot Davis, Penson said.
Welchs lawyer, Veronica Brinson, asked several questions during the hearing. Penson was unable to answer some of the questions and said another detective is taking the lead on the case.
Brinson argued that the charges against Welch should be dismissed or reduced, saying she didnt think he was afforded a meaningful commitment hearing. The purpose of a commitment hearing is for a magistrate to hear testimony about why a person was arrested and then to determine if there is enough probable cause for the case to move forward.
Magistrate Cedric Leslie ruled the case should continue to Bibb County Superior Court.
Welch is being held at the county jail without bond.
Brinson declined to comment following the hearing.
