Markisa R. Davis was walking home from Phil’s Convenience Store on Napier Avenue two years ago.

As she crossed the three-lane road near Atlantic Avenue about 8:45 p.m., a Macon police car came down the road. Officer Todd Dublin swerved to miss Davis and struck a utility pole.

Davis, 33, filed a lawsuit this week seeking more than $13,000 in damages, claiming that the mirror on Dublin’s car struck her in the arm and caused other injuries when she fell.

At the time, police who responded to the crash said Davis wasn’t injured, but she was taken to The Medical Center of Central Georgia, according to a police report.

The police department referred comment about the lawsuit to the city attorney’s office, which declined comment because the office hasn’t been served with a copy of the court filing.

Information about whether Dublin was injured or disciplined was not available Friday.

Davis suffered injuries to her arm, back and neck, said Bernadette Crucilla, Davis’ lawyer.

“She got hurt,” Crucilla said.

Crucilla contends that Dublin was driving “recklessly” and without lights or siren as he entered a center turn lane to pass other vehicles, according to the suit, filed Tuesday.

She alleges that Dublin failed to yield the right of way and was negligent.

In addition to $13,000 to cover her medical expenses, Davis is seeking compensation for lost wages, since her injuries caused her to lose her job, according to the court filing.
