Bibb County files answer in Bibb-Monroe border case

Bibb County has geared up for another legal fight in the ongoing border war between Bibb and Monroe counties.

Bibb County Attorney Virgil Adams said he expected a three-page emergency motion to intervene, and a 62-page brief supporting the motion, would be filed Thursday in Fulton County Superior Court. A judge in that court Wednesday indicated she plans next week to issue an order forcing Secretary of State Brian Kemp to accept a controversial border line from a survey that Bibb County and Kemp oppose.

An earlier case in Fulton County Superior Court was dismissed, and the latest case “involves the same parties, subject matter, and factual issues,” according to a Monroe County filing. But Adams said Bibb County -- which was a party in the earlier case -- was never told of the latest case until reporters began calling him about Wednesday’s decision. Adams said he’d even run into Monroe County’s attorney, but she never mentioned the new case.

The filing says Bibb County knows its side of the case better than the Attorney General’s Office, which is representing the Secretary of State’s Office.
